These Curator Terms supplement the Lost Hills Terms of Service and the Privacy Policy. They describe the rules, compliance expectations, and payment mechanics that apply when you review artist submissions inside the Lost Hills marketplace.
These Curator Marketplace Terms of Service (the “Curator Terms”) are a binding agreement between you, acting individually or on behalf of the entity that operates your curator brand (“you”, “your”, or “Curator”), and Lost Hills, LLC (“Lost Hills”, “we”, “us”, or “our”). The Curator Terms govern every aspect of your participation in the Lost Hills marketplace, including the creation of listings, receipt of submissions, distribution of payouts, and all communications with artists and Lost Hills personnel.
By onboarding as a Lost Hills curator, integrating playlists or profiles, or continuing to accept submissions through the marketplace, you agree to comply with these Curator Terms, the general Lost Hills Terms of Service, Privacy Policy, Cookie Policy, Anti-Fraud Policy, and any supplemental policies referenced herein (collectively, the “Platform Agreements”). If there is a conflict between these Curator Terms and any other Platform Agreement, the stricter obligation that better protects artists, brands, or Lost Hills will apply unless we expressly state otherwise in writing.
You represent that you are at least 18 years old (or the legal age of majority in your jurisdiction), can enter binding agreements, and have all rights needed to administer the playlists, accounts, or channels you submit. Lost Hills may require proof of identity, territory tax IDs, catalog ownership, or evidence of account control at any time.
We reserve the right to accept, deny, or pause any curator application in our sole discretion. Approval may require live review of your playlists, social channels, historical placements, and engagement data. Verification is not permanent: you must re-verify upon request, after material changes to your brand, or when our fraud or compliance monitoring triggers a manual review.
Curators are solely responsible for maintaining the confidentiality of their credentials and any device that accesses Lost Hills systems. You will immediately notify Lost Hills of unauthorized access or suspected breach. We may log or suspend sessions that originate from suspicious networks or automation.
You may not rent, sell, or otherwise transfer your marketplace access or dashboard to any third party without written approval. Contractors, assistants, and collaborators must operate under your supervision and remain bound to these Curator Terms.
Every playlist, content channel, or service offering (“Listing”) must remain truthful, current, and free of misleading claims. Lost Hills may request proof of average listenership, audience geo breakdowns, editorial methodology, or past placements to confirm that submissions deliver the value advertised in your listing.
You agree to maintain consistent editorial standards, avoid payola or bot amplification, and only accept submissions that align with the genres, moods, or campaigns represented in your listing. Promotional bundles that guarantee placements, streams, or algorithmic boosts are prohibited.
Lost Hills processes artist payments, retains the applicable platform fee, and remits curator payouts according to the cadence described in your dashboard. You authorize Lost Hills to act as your limited payment collection agent for amounts owed to you by artists and acknowledge that payment to Lost Hills satisfies the artist’s obligation.
You will provide all tax forms requested (e.g., W-9, W-8BEN, VAT registration) before payouts can be released. You are solely responsible for remitting any taxes, duties, or social contributions arising from marketplace income. Lost Hills may withhold payments when required by law or when an investigation is pending.
All communication with artists must occur through official Lost Hills channels unless an artist explicitly consents, inside the submission thread, to move off-platform. You may not solicit direct payments, external tips, or barter arrangements related to a Lost Hills submission.
You must disclose if you intend to pitch an artist opportunity beyond the original listing (e.g., sync opportunities, social posts, paid ad placements) and obtain the artist’s written agreement inside the marketplace thread.
Lost Hills continuously monitors curator behavior for signs of artificial streaming, fake followers, data scraping, suspicious conversion rates, duplicate accounts, or other manipulative practices. You agree to cooperate fully with any investigation, including providing analytics, platform screenshots, ownership attestations, or back-end access logs.
We may pause your listings, hold payouts, or hide your curator profile while we review potential policy violations. Lost Hills decisions regarding fraud or trust & safety escalations are final.
Curators gain access to certain artist information, including unreleased tracks, contact details, submission notes, and review history. You will treat all such information as confidential and use it solely for evaluating the submission in question.
You may not build separate marketing lists, sell data, or share platform insights with competitors. Lost Hills may aggregate anonymized curator performance data for internal analytics and public transparency dashboards.
You may only access the marketplace through published interfaces such as the Lost Hills dashboard, official APIs, or mobile experiences. Scraping, reverse engineering, or interfering with platform security features is prohibited.
Any beta tools, AI features, or internal dashboards shared with you remain confidential. Lost Hills may log interactions for quality assurance, machine learning, or support.
Lost Hills may modify, suspend, or terminate your curator account or specific listings at any time for convenience or cause. Reasons include but are not limited to breach of these Curator Terms, low fulfillment rates, unresolved disputes, fraud investigations, or reputational risk to Lost Hills and its community.
Upon termination you must stop representing yourself as a Lost Hills curator, cease using any marketplace badges, and complete outstanding submissions to the extent feasible. Sections that naturally survive termination (confidentiality, payments owed, indemnification, limitation of liability, dispute resolution) will remain enforceable.
You represent and warrant that (a) you have the right to enter into these Curator Terms; (b) your listings and communications do not infringe the rights of any third party; (c) you will comply with all applicable laws, including consumer protection, advertising disclosures, tax, privacy, and intellectual-property regulations; and (d) you will not introduce malicious code or harmful content into the platform.
You agree to indemnify, defend, and hold harmless Lost Hills, its affiliates, and their officers, directors, employees, and agents from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of your breach of the Curator Terms, your misuse of the platform, or your interactions with artists.
To the maximum extent permitted by law, Lost Hills disclaims all warranties, express or implied, regarding the marketplace, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement. The platform is provided on an “as is” basis and may contain bugs, downtime, or interruptions.
Lost Hills will not be liable for indirect, incidental, consequential, punitive, or special damages, including lost profits or data, even if we have been advised of the possibility of such damages. Our aggregate liability related to the curator program will not exceed the total fees paid or payable to you during the six (6) months preceding the event that gave rise to the claim.
We may update these Curator Terms at any time. We will post the updated version at this URL and, when material, notify you via email or in-product messaging. Continued participation after changes take effect constitutes acceptance of the revised Curator Terms. If you do not agree, you must stop using the marketplace.
